MINUTES OF THE REGULAR MEETING

JUNE 21, 2006


The Regular Meeting of the Board of Trustees of the Village of Aurora, New York was called to order in the Firehouse Meeting Room at 7:32 PM on June 21, 2006 with Deputy Mayor Zabriskie presiding.


PRESENT: Deputy Mayor Ken Zabriskie, Trustees Jim Chase, George Farenthold and  Janet Murphy.


ALSO PRESENT: David Brooks, Debbie Brooks, Grace Bates (7:40), Melinda Kostreva (Treasurer) and Nancy Yann (Clerk).


PLEDGE OF ALLEGIANCE


DISCLAIMER:   Trustee Farenthold declared to those in attendance that he was married to Lisa marsh Ryerson, President of Wells College.


APPROVAL OF MINUTES: 


Trustee Farenthold moved approval of the May 17, 2006 Public Hearing Minutes with corrections noted.  Seconded by Trustee Murphy, motion carried 4:0.


Trustee Chase moved approval of the May 17, 2006 Regular Meeting Minutes as corrected.  Seconded by Trustee Murphy, motion carried 4:0.


Trustee Farenthold moved approval of the May 24, 2006 Special Meeting To Discuss the Village Website Minutes as written.  Seconded by Trustee Chase, motion carried 4:0.


CHANGES TO THE AGENDA:  The Clerk noted the following additions to the Agenda:  1)


MAYOR'S ANNOUNCEMENTS:


Deputy Mayor Zabriskie had no announcements.


CLERK'S ANNOUNCEMENTS:


The Clerk announced that she would like to put an ad in the newspaper to advertise for a Substitute Clerk so that she would be able to take some vacation time.  She asked the Board for their input and stated that she would like to put the ad in the paper after the July Board meeting.  The Board agreed to have their “requisites” for this position.


VISITOR RECOGNITION:


Deputy Mayor Zabriskie recognized Dave Brooks, Debbie Brooks and Ryan Colvin.  Ryan will talk to the Board regarding the Street Rehabilitation Project under Old Business.


TREASURER'S REPORTS:


A.Monthly Reports:


Trustee Farenthold moved to accept the Monthly Reports for May 2006.  Seconded by Trustee Murphy, motion carried 4:0.



B.Budget Modifications

  

Trustee Chase moved to approve the Budget Modifications as follows:


GENERAL FUND:


$96.90 FROM A 1210.4 – Mayor – Contractual TO A 6410.4 – Public Relations – Web Site


WATER FUND:


$106.53 FROM F 8340.2 – Transmission & Distribution - Equipment TO F 8340.1 – Transmission & Distribution – Personal Services


SEWER FUND:


$803.69 FROM G 8130.2 – Sewage Treatment – Equipment TO G 8130.1 – Sewage Treatment – Personal Services


$34.13 FROM G 9010.8– State Retirement TO G 9030.8 – Social Security


Seconded by Trustee Farenthold, motion carried 4:0.





C.Approval of Bills:


Trustee Chase moved approval of bills in the General Fund for claims #1 to #54 in the amount of $18,367.99.  Seconded by Trustee Farenthold, motion carried 4:0.


Trustee Farenthold moved approval of bills in the Water Fund for claims #1 to #54 for $7,283.73.  Seconded by Trustee Chase, motion carried 4:0.


Trustee Farenthold moved approval of bills in the Sewer Fund for claims #1 to #544in the amount of $5,118.93.  Seconded by Trustee Murphy, motion carried 4:0.


Grace Bates asked about the “Pocket Parks” located throughout the Village, especially at the Lafayette Street Extension.  Deputy Mayor Zabriskie stated that the Board would be looking at the Bids later in tonight’s meeting.  Trustee Farenthold did not feel that was necessary to need to pave all the way down.  He also stated that he had walked down the road with Dave Reynolds.  Who is the Village trying to serve?  Trustee Zabriskie commented that many residents of the Village do not own lakefront property and that the Village had these right-of- ways to the lake for just that reason.  There was a comment that there was no real access to the Village Park.  Trustee Zabriskie stated that this project would not be a cost to the Village nor a burden to the taxpayers.  There is to be NO PARKING along the right-of-ways.  Grace Bates asked why the Village could not focus on the two existing Village Parks?  Trustee Farenthold stated that the Village was not encouraging people to drive and/or park on these right-of-ways.  Trustee Zabriskie stated that the roads are there for fire protection, as the Village would be liable if there was a fire and the trucks could not get there.  Trustee Chase commented that this could be accomplished on a smaller scale if needed.


OLD BUSINESS:


Deputy Mayor Zabriskie asked Ryan Colvin from MRB Group to go over the process for awarding the Bid for the Street Project.  Mr. Colvin reminded the Board that it would be wise and his suggestion for the Board to go into this project with a 10% contingency.  A “Notice of Awards” and a “Notice to Proceed” will have to be sent to the Contractor getting the Bid.  There was a lengthy discussion on where to save money and how to save money, what could be cut and what really needed to be done.  Re-use of milling would help reduce the cost.  Trustee Farenthold stated that he felt that Orchard Lane was the first concern.  Trustees Zabriskie, Murphy and Chase did not feel that this should take priority over the rest of the Village Streets.  Trustee Zabriskie read into the Minutes letters that were sent from Doug Bates and Dave & Gail Reynolds (see attached).  Trustee Chase said that he had received a call from Jim Avery regarding the access to his property.  He will still have proper access to his lakefront property.  When the Village is ready, the Final Plan will be sent to notify al the Village Boards.


A.Buildings and Grounds:


Trustee Farenthold had nothing to report except that the Clerk had given had asked him to report on the exhaust fan in the meeting room at the firehouse.  It was stated that this fan may never work properly – you should open the door to Apparatus Room when running.  However, the fan does not work at the present time.


B.Recreation, Parks and Public Events:


Trustee Murphy reported that she would be going to the Preservation Panel on July 5th to show them the final plan for the Village Park sign.


C.Streets and Public Safety:


Trustee Chase had nothing to report.


D.Water and Sewer:


Trustee Zabriskie reported that there were a couple of new services that replaced old services on Cherry Avenue.


Trustee Zabriskie reported that DEC did their Annual Inspections.


E.Community Preservation:


There was nothing to report.


F.Planning Board:


There was nothing to report.


G.Zoning Board of Appeals:


There was nothing to report.


H.Zoning Officer:


No report was received.


Historian:


There was nothing to report.


NEW BUSINESS:


The Clerk reported that due to a clerical error, Laurie and Criag Lounsury had asked for a tax correction on their taxes.  Trustee Chase moved the following Resolution:

Authorizing Correction of Tax Errors in the Village of Aurora


To correct a clerical error or an error in essential fact as specified below, as it exists on the 2005 Final Assessment Roll.  The petition presented to the Director of Real Property Tax Services was received too late to make the necessary adjustments before the extension of taxes.


WHEREAS, the following petition was presented to the Director of Real Property Tax Services who found it to be correct, now therefore be it


RESOLVED, that the Director of Real Property Tax Services under Real Property Tax Law 553-554 and 556A be authorized to make the change set forth hereafter, and be it further


RESOLVED, that a corrected tax statement shall be prepared, or a refund of any overpayment of taxes be made, as is applicable, and be it further


RESOLVED, that the 2006 Village Tax Roll shall be corrected as follows:


Village of Aurora, Tax Map No. 182.13-1-14, assessed to Laurie & Craig Lounsbury, 48 Cherryy Avenue, Aurora, New York.  Clerical Error.  The Lounsbury’s had applied in a timely manner in accordance with the requirements of Section 510 of the Real Property Tax Law that the assessed valuation of the real property identified above, under their ownership has been adjusted as follows as per Cayuga County Real Property Tax Office :



Prior Assessed Value$145,000

Current Year Tentative Assessment$135,000

Net Change - $10,000


Village Tax Rate is $2.70 per thousand dollars


Total Amount Due to Village of Aurora$364.50


Motion made by Trustee  Chase to accept the change.  Seconded by Trustee Murphy, carried 4:0 as called:

Debbie Brooks, Secretary/Treasurer for the Aurora-Ledyard Fire District announced that there would be no contract for the High Speed Internet Service between the Fire Department and the Village.  The letters that were issued offering the service and the letter accepting the service would serve for the contract.  The service will be billed monthly.


The Clerk announced that Mayor Gunderson had asked to set up a Special Meeting for Monday, June 26, 2006 to award the Contract for the Street Improvement Project.  The meeting will begin at 4 PM.  All were in agreement for this meeting.  Dave Dempsey wills also b e there to discuss insurance matters.


The Clerk announced that that the Contract between the Village and the Aurora Free Library was up for renewal.  The only difference this year is that it went from $2,000.00 to $2,500.00.  Trustee Chase moved to renew this agreement.  Seconded by Trustee Farenthold, motion carried 4:0.


The Clerk announced that the Williamson Law Book Account Software Contract was due at the same cost as last year, $700.00.  Trustee Chase moved approval.  Seconded by Trustee Farenthold, motion carried 4:0.


The Clerk reported that the Williamson Law Book Payroll Contract was also due for renewal at the same cost, $550.00.  Trustee Murphy moved approval.  Seconded by T4rustee chase, motion carried 4:0.


The Clerk reported that the Williamson Law Book Water/Sewer Contract was also up for renewal at the same cost, $700.00.  Trustee Murphy moved approval.  Seconded by Trustee Farenthold, motion carried 4:0.


With no further business to discuss, Deputy Mayor Zabriskie asked a motion to adjourn.
